Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Shipcare platform operated by Shipcare based in Constanta, Romania.
1. Definitions and Interpretation
In these Terms, "Company", "We", "Our", or "Us" refers to Shipcare. "User", "You", or "Your" refers to the seafarer, maritime professional, or shipping organization accessing or utilizing our recruitment portal and associated services.
2. Acceptance of Terms
By accessing or using our website, submitting applications, or engaging with our recruitment services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services.
3. User Accounts and Eligibility
To use certain features of the platform, you must register for an account. You must be at least 18 years of age and hold valid legal documentation and maritime certifications as required by international maritime law (STCW, MLC, etc.) to apply for positions through Shipcare. You are responsible for safeguarding your account credentials.
4. License to Use Platform
Subject to your compliance with these Terms, Shipcare grants you a limited, non-exclusive, non-transferable, revocable license to access and use our platform for personal career advancement or legitimate B2B maritime recruitment purposes.
5. Prohibited Conduct and Restrictions
You agree not to misuse the platform. Prohibited activities include submitting falsified certification documents, misrepresenting professional experience, scraping data without authorization, transmitting malware, or interfering with the operational security of our systems.
6. Intellectual Property Rights
The service and its original content, features, and functionality are and will remain the exclusive property of Shipcare and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.
7. Disclaimer of Warranties
Our services are provided on an "AS IS" and "AS AVAILABLE" basis. Shipcare makes no representations or warranties of any kind, express or implied, regarding the accuracy of vessel listings, employer availability, or the immediate placement of candidates.
8. Limitation of Liability
In no event shall Shipcare, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the services.
9. Indemnification
You agree to defend, indemnify, and hold harmless Shipcare and its licensee and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your misuse of the platform.
10. Termination and Suspension
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
11. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Constanta, Romania.
12. Changes and Policy Modifications
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice prior to any new terms taking effect by posting the updated terms on this page with a revised effective date.
